Terms & Conditions

Registering in the Rochford Wines Competition Draw is deemed to be an acceptance of the following terms & conditions.

The Promoter is Rochford Wines (ABN 73 583 879 138) Corner Maroondah Hwy and Hill Road, Coldstream Victoria 3770, Australia

Promotion commences 9am AEST 1st October 2007 and will conclude 30th September 2008.

Entry is open to the general public Australia wide, although giveaways can only be delivered to an Australian address or picked up from Rochford Wines in Coldstream. Overseas residents need to be aware of this and if no Australian address or pickup can be arranged within 14 days, a forfeiture of redemption will take place.

Employees and their immediate families of the Promoter are ineligible to register.

It should be the presumption that entering via means of email promotion, vote now promotion, sms competition or by entry at our cellar door, that you are opting in to receive email or SMS marketing communications from the Promoter. If you do not want to receive this type of marketing you should ensure you have checked the option boxes when available to not receive marketing materials or you may notify Rochford Wines at any time to "opt out" of receiving promotional material by calling direct on 03 5962 2119, by emailing mailinglists@rochfordwines.com.au or unsubscribing on the Rochford Wines website

If giveaways are not claimed within 14 days of draw date the Promoter will deem the giveaway a forfeiture. A giveaway cannot be transferred, exchanged, sold or redeemed for cash. The Promoter retains the right to issue wine or concert ticket giveaways at its discretion.

Giveaways of wine can only be accepted by registrants over the age of 18 or they must forfeit their giveaway. A registrant under the age of 18 may authorise a person over the age of 18 to receive their giveaway, although this will need to be stated in writing and Identification proving age will need to be shown.

How to Register:

Registering is available via the website at http://www.rochfordwines.com.au/it/email_promotion.html and via an email sent with a link to the competition, or via SMS, or via entry placed at the Rochford Wine premises, or via the vote now promotion.

It is a mandatory requirement for registrants to supply their details (first name, last name, email address, mobile number is optional. To be a valid registrant, all details must be completed correctly (errors and omissions accepted at the Promoter's sole discretion.)

In regards to the Email Promotion the registrant can increase their chance of redeeming a giveaway by referring the promotion to a friend and submitting a valid email address.

Giveways:

The giveaways and draw dates will be named by Rochford Wines below although Rochford Wines may at any time exchange the giveaway without notice to another giveaway of same value. The recipient will be notified by email, and may be published on the promoters website http://www.rochfordwines.com.au/ and at the promotors discretion in other print media.

Redemptions:

Redemptions of wine will only be issued once points, ID and addresses are checked by the promoter and wines issued will be at the discretion of Rochford Wines. By redeeming points for wine, points will then be deducted from the total amount of points accumulated by a registrant. Verification procedures will take place by the promoter to ensure nominated details are genuine and not invalid, doctored or fraudulently added.

All entries are the property of the Promoter. By entering this Promotion, you understand and agree that the Promoter may use the information provided by you for future marekting purposes, but values your privacy and will not share this information with any other third parties unless required by law. Opting in to receive email or SMS marketing communications from the Promoter is a requirement of participating in this promotional giveway. If you do not want to receive this type of marketing you should ensure you have checked the option boxes not to receive marketing materials. If for any reason this promotion is not capable of running as planned, the Promoter reserves the right in its discretion to modify the terms of the promotion including the giveaways and these Terms & Conditions. Any tax liability arising, as a result of accepting any of the giveaways is the responsibility of the winner. The promoter will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss, or for any personal injury suffered or sustained as a result of entering this promotion or receiving, taking or using any giveaway except for any liability which cannot be excluded by law. The Promoter's decisions are final, and no correspondence will be entered into. If for any reason this Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, or any other causes beyond the control of Promoter which corrupt or affect the administration security, fairness, integrity, or proper conduct of this Promotion the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion. The Promoter reserves the right in its sole discretion, to disqualify any individual who tampers with the registrant process, or may benefit from such tampering or that enters invalid email addresses.

Except for any liability which cannot be excluded by law the Promoter: is not responsible for any problems or technical malfunction of any telephone network or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including (but not limited to) any injury or damage to participants or any other person's computer related to or resulting from participating in this Promotion; accepts no responsibility for any incorrect or inaccurate information caused by any of the equipment or programming associated with or utilized in connection with this Promotion, or by any technical error that may occur in the course of this Promotion, including (but not limited to) any failure of the computer system or other equipment to determine winners in accordance with these Terms and Conditions; and accepts no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to or alteration of registrant details.

SMS competition specifics

Information on how to enter and prizes form part of these conditions. By entering the competition, you acknowledge that you have read and understood, and agree to be bound by these conditions. IF YOU DO NOT ACCEPT THESE CONDITIONS YOU SHOULD NOT ENTER THE COMPETITION OR OPT OUT by means stated above as soon as possible after entering.

Entrants under the age of 18 are to gain permission from their parents before entering the competition. We reserve the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these conditions.

To enter, SMS name and email address to 0429 888 777. The main prize winner will be randomly selected from all entries. This will take place at 12pm 1st August 2008, at Rochford Wines, Corner Maroondah Hwy and Hill Road, Coldstream, VIC 3770.

The main prize winner will receive a year supply of wine being -12 cases of Rochford Wine. This will be sent out free of charge as one case per month for 12 months, or may be picked up from the Rochford Wines cellar door at Cnr Maroondah Hwy & Hill Road, Coldstream, VIC 3770.
If a prize winner is under 18 years of age, the prize will be awarded to the winner subject to the prior written consent of the winner's parent or legal guardian. We may make such inquiries as we deem necessary to satisfy ourselves that such consent has been obtained.

The main prize winner will be notified by telephone and confirmed by mail. Minor prize winners will be randomly selected and will be contacted by SMS message and then later by phone or mail. Prizes can be redeemed immediately from Rochford Wines by calling 03 5962 2119. The prizes are not transferable or exchangeable and cannot be taken as cash. These prizes will ONLY consist of tickets to the actual concerts. Prizes DO NOT include travel to the allocated venue.

A re-draw will take place at the promoters' discretion should the main prize "a years supply of wine" be unclaimed or unredeemable, at This will take place on 15th August 2008, at Rochford Wines, Corner Maroondah Hwy and Hill Road, Coldstream, VIC 3770. Rochford Wines are not be responsible for any incorrect or inaccurate information, either caused by you or for any of the equipment or programming associated with or utilised in the competition, or for any technical error, or any combination thereof that may occur in the course of the administration of the competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
Rochford Wines are not responsible for lost, late, incomprehensible or incorrect entries in the competition. We also accept no responsibility for any tax implications that may arise from prize winnings in the competition. You should seek Independent financial advice about such matters. In the event of war, terrorism, state of emergency, disaster or (without limitation) any other event outside our reasonable control, we are entitled to cancel, terminate, modify or suspend the competition - subject to any written directions from the various regulatory bodies responsible for supervising the conduct of the competition (the Lotteries Departments).
If for any reason the competition is not capable of running as planned (including but not limited to) technical failures, unauthorised intervention, fraud or any other causes beyond our control which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, we are entitled in our sole discretion to disqualify any individual who tampers with the entry process, and (subject to any written directions given by the various Lotteries Departments), to cancel, terminate, modify or suspend the competition.
Rochford Wines will not be held responsible for any loss, damaged or stolen prizes.
Information requested in this competition is necessary for Rochford Wines to identify you as an entrant to this particular competition. By completing and forwarding this information, you consent to Rochford Wines collecting, retaining and using the personal information provided by you for the development of Rochford Wines, to keep you informed about the Rochford Club, Concert, Events and its activities and products and for direct marketing purposes.
